Administrative information
Access to medical and administrative
records :
The
Parc Monceau International Clinic possesses a network of computers
for the purpose of managing patient records and calculating statistics,
in strict accordance with medical confidentiality norms. Unless
we receive your express wishes to the contrary, certain information
pertaining to you and collected during your visit will be saved
on computer and reserved exclusively for administrative and medical
data management concerning the patient at all stages of their visit
and for the collection of statistics in accordance with the Law
of 22nd July 1996 concerning the acquisition and treatment of medical-related
data stipulated in article L 710-6 of the French public health code.
law concerning data protection, notably articles 34 and 40, any
patient may exercise their right to view or rectify their medical
records in consultation with the doctor in charge of medical information,
via the practitioner who created the file. Any doctor appointed
by you may view your entire medical records. (Articles
26, 27, 34, 40 of Law no. 78-17 of 6th January 1978 concerning data,
files and freedom.)
Medical records are communicated by the practitioner of the clinic
responsible for the patient, or in their absence, by the doctor
elected by the Medical Committee. This is carried out via the intermediary
of a doctor elected to this effect by the patient or his/her legal
representative. This doctor will pass on all medical records in
accordance with the professional code of ethics. (Decree
no. 92-329 of 30th March 1992)
Rules concerning the legal protection
of incapable majors :
Where
a patient is no longer capable of safeguarding their own interests,
that person should be represented or assisted in order that their
interests be safeguarded in accordance with the Law of 3rdJanuary
1968 on the protection of incapable majors. In such cases, a supervising
judge may decide on protective measures at the doctor's or family's
request. Various forms of legal protection exist (legal protection,
guardianship, wardship) to suit each individual situation.
